Dallas Huston asks for new trial

The Lincoln man is serving a life sentence in the death of 22-year-old Ryan Johnson.

A Lincoln man originally accused of helping his boyfriend commit suicide and later sentenced to 50 years to life in prison for second-degree murder in the case is asking the Nebraska Supreme Court for a new trial.

Dallas Huston was sentenced in May 2011 for the 2009 death of 22-year-old Ryan Johnson.

An autopsy showed Johnson died of asphyxiation. He also had taken a potentially fatal dose of sleeping pills.

Police say Huston told others about the death and that he helped. He was initially charged with assisting a suicide, but police determined that Huston suffocated Johnson with a pillow after Johnson tried to free himself from the plastic.

In his appeal, Huston argues that his trial lawyer ineffective and that the trial court should not have allowed some evidence.
