Michael Arellano has been charged in the shooting death of 38-year-old Shane Newman.

There are four charges including 2nd Degree Murder and 2nd Degree Assault for shooting a second man at the party who was treated at the hospital for non–life threatening injuries.

"At this point, you always talk to the police and you read all of the reports that have been done and the crime scene photos and everything else that's available to you," County Attorney Joe Kelly said.

It all happened outside a house near 3rd and West Saunders Ave. early Saturday morning.

We spoke with the suspect's father, Michael Arellano Sr. a few days ago.  He says his son and Shane were friends and he's shocked about what happened.

"I just want to apologize to Shane's family for his loss," Arellano said.  "Shane was a good friend of mine.  We used to play in pool leagues and stuff together.  From my family to his, we apologize.  This is a very bad moment for everybody involved."

The Probable Cause Affidavit says Arellano told police he was walking away from a fight between his friends and Newman when he heard the gunshots.

He told police a friend walked by him after the gunshots and said he had just been shot.  He says another friend handed him the gun and told him to get rid of it.

He told police he is not the person who fired the gun but prosecutors say they don't believe him and that he was found with the gun at his home.

"Anybody who has ever met Michael knows that he'd do anything for anyone," Arellano Sr. said.  "He was a very kind–hearted, intelligent young man."

The next time Arellano will appear in court should be in the next couple of weeks for a docket call.

Michael Arellano has been charged in the shooting death of 38-year-old Shane Newman.

Arellano was in Lancaster County court Wednesday.  The 21-year-old is charged with 2nd Degree Murder, 2nd Degree Assault, and 2 counts of Use of a Firearm to Commit a Felony.

Police said the shooting happened during a party at his father's home at 316 W. Saunders Ave.  Police also said Arellano shot Newman three times and another partygoer in the leg.  Newman was a friend of Arellano's father.

Police reports say Newman got into an argument with another man outside the house and Arellano fired shots.

Arellano told police he never fired a gun, and left the party after hearing gunshots.  In court documents, Arellano told investigators a gun was handed to him by his friends and he hid it in the woods.  He said he later went back for the gun after learning Newman was dead.

Arellano was arrested and being held without bond until charges were filed Wednesday.
