16-year-old Carley Benson's case will go to juvenile court. Benson, of Waverly, was 15 when she was driving a car that crashed last August on a gravel road near Waverly. The accident killed 15-year-old Taylon Artman of Eagle. Prosecutors say Benson was driving without a license.
Benson is charged with motor vehicle homicide in the case. She appeared before a Lancaster County District Court judge in December asking for the transfer. In Monday's decision, Judge Andrew Jacobsen said the state did not demonstrate that the case should be retained in the adult court system.
