Hergert Pre-Trial Begins

A pre-trial hearing was held Wednesday before the Nebraska Supreme Court on the impeachment of University of Nebraska Regent David Hergert. Hergert paid more than $33,000 in fines for breaking campaign finance laws when he was elected in 2004.Hergert's attorney argued that the campaign violations occurred before Hergert took office and therefore are not impeachable.

However, the legislature's attorney said the law violations resulted in Hergert winning the election, and then he violated the law after he took office in 2005.

In the end, the court took the motion to dismiss under advisement and did not indicate when it would decide if the trial will go forward. If the trial proceeds, it would begin Monday morning in the capitol's supreme court chambers. Hergert was not present at Wednesday's proceedings.
