Lincoln man appeals ax killing conviction

The lawyer for a Lincoln man convicted of  killing his mother with an ax says his client is insane and should not have been required to stand trial in the death.

Matthew Fox's appeal will be heard Tuesday by the Nebraska Supreme Court. It says a lower court erred by not finding him incompetent to stand trial. Fox was sentenced to life in December for first-degree murder in the death of his mother, Sherry Fox. Prosecutors say Fox hit his mother with an ax 14 times in the basement of their home in October 2008. Fox was initially found incompetent to stand trial and spent more than a year in a state psychiatric hospital before being found competent by a Lancaster County court in 2010.
