Nuclear Waste Appeal Bad News For NE
Bad news for Nebraska Wednesday, when it comes to a nuclear waste lawsuit.. The 8th U.S. Circuit Court of Appeals upheld a ruling that the State owes 15 million dollars for trying to block construction of a low-level radioactive waste dump in Boyd County. The dump was to hold waste from five states. The appeals court upheld an earlier ruling by a U.S. District Judge in Lincoln.. He had ruled that former governor, Ben Nelson, orchestrated a politically motivated plot to keep the dump out of Nebraska. Current Governor Mike Johanns says the State likely will appeal the ruling. Nebraska's options include asking the court to re-hear the case or petitioning the U.S. Supreme Court.. The State has already spent about 25-million-dollars defending against this lawsuit.
