Update: One Dead in Rollover Near Waverly

The sheriff's office says the fatality victim had been drinking alcohol.

24-year-old Seth Coats was killed in the accident early Sunday.  Chief Deputy Jeff Bliemeister says the passengers in Coats' car told deputies that speeds reached up to 100 miles per hour.

37-year-old Damian Smith was cited for drunk driving.  The sheriff's office says it happened around 1:30 Sunday morning at North 70th and Waverly Roads.  Police say a Saturn driven by Smith turned onto Waverly Road and collided with another car.

Dan Bissell and his wife live next to the intersection where the accident happened.   They said they didn't hear it, but woke up about an hour later and saw all the police and wrecked cars.

“We saw the cars and how messed up they were,” Bissell said.  “They had already life flighted somebody and the only thing we saw was just the vehicles and the police.”

The sheriff's office say Coats was driving his Cadillac east bound on Waverly Road at a very high speed when it crashed into Smith's car and then flew into a utility pole.

“There was a total of five people in the Cadillac,” Sergeant Mike Novacek said.  “Preliminary investigation indicates no one was wearing their seatbelts.  Some of the passengers were ejected from that vehicle.”

Coats and two other passengers were ejected from car.  Coats was life–flighted to Bryan West but later died from his injuries.

The four other passengers in Coats' car and the passenger in Smith's car were taken to hospitals and treated for non life–threatening injuries.

Residents who live nearby say they've complained about the intersection before.  There was another accident there just a couple weeks before Sunday mornings fatal crash.

“There's always somebody flying down the roads there,” Bissell said.  “It's pretty dangerous.”

Smith was ticketed for suspicion of driving while intoxicated.  He suffered minor injuries and was treated at the scene.
