Update: Police say man raped unconscious woman in Haymarket

Lincoln Police were called to an alley in the Haymarket around 8:30 p.m. Sunday after several reports of a man sexually assaulting a woman.

“Witnesses described a female unconscious while a man was having sex with her,” Officer Katie Flood said.

A University of Nebraska Police Officer was first on the scene and found the 21–year–old victim and the suspect in the alley between 8th and 9th Streets and P and Q Streets.

They arrested 29–year–old James McWilliams for first degree sexual assault.

Police say the victim was intoxicated and confused.

“The victim recalled drinking with friends at a bar but did not remember leaving and certainly never consented to having sex with a man in the alley,” Officer Flood said.

Court documents say McWilliams told police he met her on the sidewalk and they started to talk. He says they walked into the alley and engaged in consensual sex.

The victim was taken to a local hospital for evaluation.

Police say she told them she had more to drink than usual that night but doesn’t believe she was drugged.

Police say this is McWilliams’ first sexual offense. He could face up to 50 years in prison if convicted.
