State sued after 12-year-old killed by mother

The family of a 12-year-old boy killed by his mother intends to sue the Nebraska Department of Health and Human, accusing the department of negligently handling the case.

Last month Angela Manns pleaded no contest to second-degree murder for killing her son, Michael Belitz. His decomposing body was found in Manns' bathtub in July 2009.

A complaint prepared by the special administrators of Belitz's estate is expected to be filed in court on Wednesday. It alleges the agency failed to properly respond to calls from Angela Manns in which she said she needed help and that she needed to place her son in foster care.

State officials have declined to comment. A complaint filed with the Nebraska's State Claims Board was denied in February.
