Updated: Escapee will not face charges

An escapee from the Lincoln Regional Center will not face criminal charges.

Lancaster County Attorney Gary Lacey says his hands are tied.  Lacey says he cannot prosecute Shane Tilley for escaping Wednesday from the facility.  Tilley was found not guilty by reason of insanity in the stabbing death of Andy Lubben in 2006.  It's because of that ruling, the law prevents Lacey from charging Tilley for escape. 

Tilley was caught Wednesday evening after an Action 3 News crew spotted him in Southwest Lincoln.  Police say just before 10am Wednesday, Tilley was on an unrestrained, supervised walk.  That's when he left the building, with therapists chasing after him. Tilley was last seen on walking eastbound from the regional center near West Van Dorn and Highway 77.
