Update: Aubrey Trail doesn’t appear for plea so he still faces three felony counts in his June 17th trial

UPDATE:
On Friday, Aubrey Trail — one of two people accused of killing Sydney Loofe — was scheduled to appear in Saline County Court.
He was supposed to plead guilty to a charge of improper disposal of human skeletal remains.
But it was not to be. Trail’s attorney Joe Murray said his client wasn’t transferred to court Friday because of health related issues.
“Something happened this morning,” Murray said. “I don’t have enough information to tell you what it was, but something happened this morning and he is not transported here.”
But in court the defense did argue for their motion to keep trail at the Diagnostic and Evaulation Center in Lincoln, rather than sending him back to a jail cell in Saline County.
Murray said Trail is in poor health and has suffered two heart attacks and a stroke.
“He’s disabled and he needs assistance with all kinds of life functions that we believe can only be provided there,” he said.
Because Trail didn’t appear in court, he was not able to plead to his charge of unlawful disposal of skeletal remains.
Murray said Trail’s health problems will not affect the trial.
“We’re going to go off the schedule,” Murray said. “I fully expect that. I expect the plea to eventually be changed and to move forward on the charges that remain.”
Trail and Bailey Boswell are accused of murdering Loofe and disposing of her body in 2017.
Murray said he hasn’t heard if Boswell will testify at the trial.
He said trail is maintaining his not guilty pleas to the other charges of first degree murder and conspiracy to commit murder.
The trial is set to begin on June 17.
Boswell’s is set for October.

UPDATE: Aubrey trail was expected to appear in Saline County Court today (Friday) and plead guilty to a charge of improper disposal of Sydney Loofe’s body. However, Trail didn’t show up to court so a judge could not allow for a plea to be entered. Trail will go on trial June 17th on three charges, first degree murder, conspiracy to commit murder and improper disposal of human skeletal remains. Trail’s attorney Joe Murray said Trail is expected to enter a guilty plea on the improper disposal charge at a later date. Murray said Trail didn’t show up today because of an illness but didn’t expand on the illness. The judge was asked to determine whether Trail will be held in Lincoln state prison facilities or the Saline County Jail while the trial is held because Trail’s attorney said he can’t get the proper medical treatment he needs in Saline County. Trail’s attorney said his client suffered two heart attacks and a stroke. We will have more information about this case as it develops.

WILBER, Neb. (AP) A man charged with killing a Lincoln woman is expected to change his plea to one of the three charges against him.
Saline County District Court records say 52-year-old Aubrey Trail faces three charges in the slaying of 24-year-old Sydney Loofe.
He’s scheduled to go on trial June 17.
He’s pleaded not guilty to first-degree murder, conspiracy and to improper disposal of Loofe’s remains.
His attorney said in a court filing Thursday that Trail wanted to change his plea to guilty to the improper disposal of Loofe’s remains and “accept responsibility for his actions.”
The motion will be heard at a hearing Friday afternoon.
Trail has said Loofe died at his hands accidentally and that he tried to get rid of her body because he didn’t think law enforcement would believe him.
Trail and Bailey Boswell are accused of killing Loofe in November 2017, dismembering her body and dumping the remains in rural Clay County.
Boswell also is awaiting trial on murder and other charges.
