Henk’s attorney claims Kofoed planted evidence
A Plattsmouth man who admitted killing his 4-year-old son is asking the Nebraska Supreme Court to consider whether evidence in his case was planted. Ivan Henk says in his appeal that there are similarities between his case and a 2006 Cass County investigation in which two men were wrongly charged in a double murder.
Former Douglas County crime scene investigator David Kofoed was convicted of tampering with evidence. Henk pleaded guilty to first-degree murder days before his trial was to begin in the 2003 death of Brendan Gonzalez. In his appeal, Henk says he relied on DNA evidence that he now believes Kofoed planted in deciding to plead guilty. Kofoed's attorney says no evidence was planted. The high court will hear Henk's appeal Tuesday.
