PROVIDENCE, R.I. (WLNE) — A West Warwick man was charged in Kent County Superior Court with lying in order to buy a gun from a licensed dealer earlier this year.
The Rhode Island Attorney General’s Office charged 43-year-old Nicholas Muschiano with one count of providing false information while attempting to secure a firearm on July 7.
Prosecutors said he tried to buy a gun from Heritage Gun and Coin in West Warwick on Feb. 25. The purchase was denied after a National Instant Background Check System check showed that Muschiano was prohibited from buying a gun.
Muschiano had pleaded no contest last July to a misdemeanor charge of violating a domestic violence-family court protective order. He was issued a domestic No Contact Order that expired Tuesday.
Prosecutors said he also has an active family court restraining order against him, which expires in March 2025.
Muschiano is accused of denying that he was on any such court order on his federal application.
He is expected back in Kent County Superior Court on Aug. 22.
