Ivan Henk In Court
The Plattsmouth man accused of killing his four year old son, appeared in Cass County District Court Monday. Ivan Henk– who is charged with first degree murder in the death of Brendan Gonzalez– walked into the court room and remained mute for the preceedings. Then, a not guilty plea was entered for him by a Cass County District judge. Monday's proceeding only lasted five minutes. Ivan Henk didn't say anything when Cass County District Judge William Zastera asked him for his plea during the arraignment in Plattsmouth. Zastera then entered the not guilty plea — which is standard procedure when the accused stands mute. Ivan Henk is accused of killing his 4-year-old son, Brendan who has been missing since January sixth. Ivan Henk is the primary suspect during the search. Henk's behavior Monday was drastically different from an unrelated court appearance in April, when he admitted to killing his son. A not guilty plea means the next step will be a jury trial in District Court. That's when the prosecution will work to prove Henk murdered his son, and then seek the death penalty. Zastera overruled a defense motion asking prosecutors to disclose how they planned to argue for the death penalty in the case. Henk's trial is scheduled for February second at 9 a-m in Cass County District Court.
