Judge says State can go forward with execution of Carey Dean Moore

A U.S District of Nebraska Federal Judge has given the permission for the State to proceed with the first execution since 1997. 

Judge Richard Kopf ruled against temporary restraining order to use the drugs.

Fresenius Kabi, a German based company argued use of them would damage their reputation, but Kopf said that’s not the case.

Kopf says it would "frustrate" the will of the people of Nebraska and Moore to grant the restraining order.

The drug company will file an appeal but it likely won’t happen before Carey Dean Moore’s execution.
