LES sues Malcolm construction company for nearly $100,000 in damaged equipment

LINCOLN, Neb. (KLKN) — Lincoln Electric System is suing a Malcolm construction company for nearly $100,000 in damaged company equipment and causing an outage.

The lawsuit — filed in the Lancaster County District Court on Friday — describes three separate incidents in which employees from WCHE LLC damaged LES’ property over the span of a year.

On June 15, 2023, LES claims employees collided with at-grade riser facilities attached to a utility pole at a home near 70th Street and Saltillo Road.

LES said the cost to repair this is $1,305.26.

On Nov. 2, 2023, employees excavating near a home near Southwest 36th and West A streets hit LES’ underground electrical wires.

LES said this incident cost them $1.911.52.

On May 4, 2024, employees were excavating again near the intersection of Southwest 24th Street and West A Street and hit LES’ underground wires.

This incident cost the electrical company $92,945.09, according to LES.

In all of these incidents, LES alleged WCHE employees failed to accurately find LES’ underground wires and use care when digging near them.

There were no court documents filed in answer to these claims.
