LINCOLN, Neb. (KLKN) — The Lincoln teenager accused of mistakenly shooting his brother is trying have his case moved to juvenile court.

About 12:30 a.m. on Dec. 24, McDaniel fired 15 rounds at a “masked figure” outside an apartment complex near 14th and Superior streets, court documents say.

The masked man turned out to be his brother, 20-year-old Johnathan McCray.

He was taken to a hospital, where he died.

McDaniel told investigators that he feared for his safety after being assaulted the week before, so he was armed with an assault rifle.

He said he would not have fired the gun if he knew his brother was the masked man.

Kentrail is charged with manslaughter and use of a firearm to commit a felony.

He is being held on a $100,000 bond.

On Thursday, District Judge Susan Strong denied a request to lower his bond.

She took the motion to transfer the case to juvenile court under advisement.
