LINCOLN, Neb. (KLKN) – A man was caught driving under suspension Saturday after his passenger littered, the Stanton County Sheriff’s Office says.

Around 10:30 p.m., a deputy pulled over a vehicle after they saw a lit cigarette being thrown out of a window on Highway 24, just east of Norfolk.

The driver, 49-year-old Brian Thies, was found to have a suspended license for driving under the influence.  He also didn’t have an interlock device in the vehicle. the sheriff’s office said.

A breath test found that Thies had been drinking but was under the legal limit, authorities said.

The sheriff’s office said that’s still a felony violation of the DUS-interlock law.

The passenger in the car was cited on suspicion of littering after she admitted to throwing the lit cigarette.
