LINCOLN, Neb. (KLKN) – A man is facing upgraded charges in a deadly shooting at an apartment near downtown Lincoln.

Jacob Mulloy, 53, had his charges upgraded Thursday to first-degree murder and use of a firearm to commit a felony, according to court records.

He was initially charged with second-degree murder.

Police Chief Michon Morrow said 52-year-old John Armstrong was shot in the head at the apartment near 11th and G streets.  He was pronounced dead at the scene.

Mulloy, who had called police, turned himself in when officers arrived, according to Morrow.

She said Mulloy, who lived in the apartment, had known Armstrong for several years.

Police said that on Tuesday, Mulloy allowed Armstrong into the residence, where they began arguing.

The argument was over Armstrong previously entering Mulloy’s apartment uninvited, Morrow said.

“Jacob is indicating that he was pushed, and the victim threatened to assault him, and he responded by shooting him,” she said.

A Lancaster County judge set Mulloy’s bond at $1 million.  He must pay $100,000 to be released from jail.

Mulloy’s next court date is May 14.
