LINCOLN, Neb. (KLKN) — A man accused of taking advantage of a good Samaritan in Lincoln by stealing his SUV will stand trial.

Tyler Livengood waived his preliminary hearing Thursday in Lancaster County Court, and the judge forwarded the case to district court.

By waiving the hearing, Livengood pleaded not guilty to theft by unlawful taking and possession of a controlled substance.

Police said Livengood asked a stranger for a ride on Nov. 14 near 17th and Q streets.

The 52-year-old man agreed to give him a ride to the area of 14th Street and Old Cheney, according to court documents, so the drove to the Phillips 66 there.

The victim went inside but realized he left his credit card in the SUV, so police said he gave Livengood the key and had him bring the card.

But while the man was paying, Livengood drove off in his vehicle, an arrest affidavit says.

The victim had a tracker on the SUV and told police where they could find it.

When police arrived at the Phillips 66 off Highway 77 and Rosa Parks Way, they saw Livengood filling up the tank, the affidavit says.

Police said he had used a marker to change one of the numbers on the front license plate.

He also had four prescription painkiller pills in a bottle with no name on it, according to police.

Livengood is scheduled to be arraigned in Lancaster County District Court on Jan. 22.
