Man was shot in self-defense during pry bar attack in York County, court docs say

LINCOLN, Neb. (KLKN) — A fight in Waco this month escalated from belly bumping to felony assault, authorities say.

About 7 p.m. on March 2, deputies with the York County Sheriff’s Office responded to a report of a shooting.

They found 60-year-old Brian Mulder with a gunshot wound in his right arm.

A deputy used a tourniquet to stop the bleeding before Mulder was taken to a hospital in York.

During the investigation, deputies determined that another man shot Mulder in self-defense during a fight.

The confrontation started when Mulder refused to leave the other man’s home, according to court documents.

An arrest affidavit says Mulder got up from the couch and “belly bumped” the man.

Shortly after, Mulder retrieved a pry bar from his vehicle and belly bumped the victim a couple more times, the affidavit alleges.

The victim told deputies that Mulder then hit him on the head with a pry bar, knocking him to the ground. Then Mulder struck him again, the affidavit says.

That’s when the victim shot Mulder, according to deputies.

A warrant was issued for Mulder’s arrest on March 5.

On March 11, Lincoln Police officers came into contact with Mulder and arrested him without incident.

He was taken to the York County Jail.

Mulder has been charged with second-degree assault, assault causing bodily injury and use of a deadly weapon to commit a felony.

His bond has been set at $100,000. He must pay 10% of that, $10,000, to be released.

Mulder’s next hearing is scheduled for April 3.
