Waverly man sentenced for bilking Social Security, Medicare of $272,000

LINCOLN, Neb. — A Waverly man was sentenced to five years of probation on Thursday for defrauding the federal government of $272,202 over 17 years.

The Social Security Administration received an anonymous tip in November 2017 that James Nieman, 45, was working as a floor installer while collecting disability payments.

He lied about his employment and income to receive Social Security and Medicare benefits from November 2001 to March 2019, according to the U.S. Attorney’s Office for the District of Nebraska.

The investigation found that Nieman received $226,737.70 in Social Security benefits and $45,464.30 in Medicare benefits for which he wasn’t eligible.

U.S. District Judge John M. Gerrard also sentenced Nieman to 12 weekends of intermittent confinement and ordered him to pay restitution, plus $100.
