Nebraska joins lawsuit challenging Biden’s win in battleground states
Nebraska is now one of 19 states that have joined the Texas election lawsuit, claiming the U.S. Constitution was violated in the way four states conducted their election.

LINCOLN, Neb. (KLKN) – Nebraska is now one of 19 states that have joined the Texas election lawsuit against four key states in the 2020 General Election.
Texas filed a lawsuit in the U.S. Supreme Court against four battleground states, claiming the United States Constitution was violated in the way those four states (Michigan, Wisconsin, Pennsylvania, and Georgia) conducted their election.
19 states filed a brief together in support of the lawsuit, Nebraska being one of them. Six of those states have asked to intervene and become parties to that lawsuit, Secretary of State Bob Evnen said Nebraska has not asked to become a party and they are simply joining the brief to show support.
“This is not a partisan politics issue, this is not something that has to do with who is ultimately certified as the President, this has to do with whether or not we are going to respect the United States Constitution,” Evnen said.
The Nebraska Democratic Party (NDP) commented on the decision to join the lawsuit, ultimately condemning the move.
“By joining this lawsuit Ricketts is telling Nebraskan’s that he believes state legislatures should pick a President, not American voters,” Jane Kleeb said. “This is an outrageous attack on the fundamentals of democracy.”
Evnen said no tax dollars will be used in this brief/lawsuit.
Michigan, Wisconsin, Pennsylvania, and Georgia have asked the U.S. Supreme Court to swiftly reject the lawsuit and avoid legitimizing bogus claims. As of Thursday, a slew of Democratic led states have now filed a counter-motion to that original lawsuit.
Nebraska’s decision to join this briefing was made by Attorney General Doug Peterson, Channel 8 News has reached out to the AG but was referred to Evnen’s office instead.
