Plaintiff appeals dismissal of fraud case against Nebraska medical marijuana initiatives
LINCOLN, Neb. (KLKN) — A ruling dismissing a legal challenge to Nebraska’s medical marijuana initiatives has been appealed.
John Kuehn, a former state senator, filed a notice of his intent to appeal on Thursday.
The Nebraska Court of Appeals said in a Friday filing that it has received the appeal.

The case centers around a pair of ballot initiatives legalizing and regulating medical marijuana in Nebraska. Nebraska voters approved both overwhelmingly in November.
Before the election, Kuehn sued the petition sponsors and Nebraska Secretary of State Bob Evnen, alleging that there was widespread fraud by petition circulators.
Evnen then joined Kuehn in the effort to invalidate the initiatives.

On Nov. 26, Lancaster County District Judge Susan Strong ruled that there was some fraud by circulators and improper conduct by notary publics.
But she found that when all the affected signatures were removed, the petitions still had more than enough.
It’s not clear when the Court of Appeals will hear the case.
The initiatives are set to go into effect this month.
