Judge issues injunction in Nebraskans for Medical Marijuana petition lawsuit

LINCOLN, Neb. (KLKN) – A federal judge issued an injunction in a lawsuit over Nebraska’s medical marijuana petition on Monday.

In the lawsuit, Crista Eggers and Nebraskans for Medical Marijuana allege that the multicounty signature requirement violates the United States Constitution.

At least 5% of registered voters from at least two-fifths of the state’s counties need to sign the petition to get the initiative onto the ballot.

According to court documents, the judge ruled that Nebraskans for Medical Marijuana would be “irreparably harmed” by the continued enforcement of the rule.

He issued an injunction temporarily blocking the requirement for petitions.

Nebraska Attorney General Doug Peterson plans to appeal the case, according to his spokeswoman, Suzanne Gage.

“This case raises important legal questions concerning the initiative process in Nebraska,” Gage said. Therefore, we will take the steps necessary to get the matter before the Eighth Circuit Court of Appeals as soon as possible.”

Nebraskans for Medical Marijuana is seeking around 87,000 signatures for its two petitions.

The deadline to submit the required signatures is July 7.
