Nebraska AG Hilgers accuses Midwest Smoke Shop of selling THC to children

LINCOLN, Neb. (KLKN) — Nebraska Attorney General Mike Hilgers sued a chain of smoke shops on Monday, accusing them of selling THC products to children.

The lawsuit, filed in Lancaster County District Court, also says Midwest Smoke Shop has sold products that have harmed both children and adults.

“Not only are these products untested, mislabeled, and dangerous, but Midwest Smoke has also repeatedly been selling these products to kids,” Hilgers said in a press release. “Nebraskans deserve better.”

Midwest Smoke Shop has locations in Lincoln, Omaha and Gretna.

Hilgers said the business does not verify customers’ ages and sells products that are designed to appeal to children.

Among the products listed in the lawsuit are Moon Buzz Gummies, which look like Trolli gummy worms, and Dazed Sour Nerds Gummies, which contain Nerds candy.

The lawsuit says the state believes that some Nebraskans have been hospitalized after consuming products sold at Midwest Smoke Shop.

Hilgers said some products contain more THC than advertised, some contain less, and some have cannabinoids that aren’t disclosed on the packaging.

The smoke shop is accused of violating the Consumer Protection Act, the Uniform Deceptive Trade Practices Act and Nebraska’s Pure Food Act.

Last year, the attorney general filed several similar lawsuits against THC retailers.

He sued Cannabis Factory in Lancaster County District Court, where the lawsuit is still playing out.
