POLL: Is the death penalty ‘unconstitutional?’

LINCOLN, Neb. (KLKN) — A three-judge panel will meet Wednesday to determine whether Bailey Boswell will be sentenced to death.
Boswell was found guilty last year of three charges in the murder of Sydney Loofe.
Her attorney had previously argued the death penalty is “unconstitutional,” saying, among other things, the state’s decision regarding who will face the death penalty is arbitrary, and could be affected by the legal experience of the prosecutor, resources of the county and prejudices or biases.
A judge ruled against the motion, and a similar motion by Boswell’s co-defendant Aubrey Trial. Trail was sentenced to death earlier this month.
The hearing to determine Boswell’s fate is scheduled to last three days.
