Murder charge against Lincoln man in September shooting to be dismissed
LINCOLN, Neb. (KLKN) — Authorities said Thursday that they are dismissing a murder charge against a Lincoln man.
Jahhrasta S. Fletcher was charged with first-degree murder last year in the fatal shooting of Robert Michael Brannon.
But Lancaster County Attorney Pat Condon said prosecutors don’t have enough evidence to disprove self-defense.
Brannon was shot in an alley near 19th and O Streets on Sept. 25, according to the Lincoln Police Department.
Police said he suffered several wounds to his chest and head and died at the scene.
Condon said the burden is on the prosecution to disprove an affirmative defense, like self-defense.
“Upon reviewing all of the investigative reports, physical evidence, and digital evidence which includes detailed forensic video analysis completed by the Lincoln Police Department, the Lancaster County Attorney’s Office does not believe there is sufficient evidence to prove beyond a reasonable doubt that Mr. Fletcher was not acting in self-defense,” he said in a press release.
Two others were charged with being an accessory to a felony, but the county attorney said this dismissal will impact those charges.
