NE Supreme Court upholds law that allows certain overseas citizens to vote in Nebraska elections

LINCOLN, Neb. (KLKN) — On Oct. 16, the Nebraska Supreme Court ruled in the lawsuit between the Republican National Committee (RNC) and the Nebraska Secretary of State Bob Evnen.

On June 22, 2026, the RNC and two Lancaster County voters filed a lawsuit against Evnen, arguing that the a certain 2005 Nebraska law is unconstitutional.

The law allows U.S. citizens born abroad to register and vote in Nebraska elections, provided they have a parent who is a registered voter in Nebraska.

The RNC argued that the law is unconstitutionally diluting the votes of lawful, state-rising citizens. They also argued that the law violates Article VI, Section 1 of the Nebraska Constitution, which mandates state residency for voters.

The Lancaster County District Court dismissed the case in August. This prompted an immediate appeal, fast-tracking it to the Nebraska Supreme Court.

The Nebraska Supreme Court upheld the Nebraska overseas voter law.
