Nebraska helps stop regulations on gas stoves, Fifth Circuit rules Biden Administration broke federal law

LINCOLN, Neb. (KLKN) — Today, the U.S. Court of Appeals for the Fifth Circuit struck down a Department of Energy rule that placed federal limits on gas stoves and cooking appliances.

The court ruled that the Biden Administration broke federal law by trying to push the rule through without the normal public process.

After the rule was issued in Feb. 2023, Nebraska Attorney General Mike Hilgers made a formal objection on behalf of 23 states. Hilgers had announced that the Biden Administration had ignored the criticism of gas stove standards and failed to hear the States that opposed them.

Today, the Fifth Circuit agreed. It found that the Biden Administration had left the opposing States out of the process.

“This is a major victory for Nebraska families and for common sense,” Hilgers said. “The Biden Administration tried to force through its gas stove agenda while shutting States like Nebraska out of the room. We fought back. Today, the Fifth Circuit overturned the rule and made clear that federal agencies cannot ignore the law just because they do not like what the public has to say. Nebraska will continue to fight federal overreach and protect the freedom of families to make their own choices.”
