Lincoln woman fights driving ticket and wins

(LINCOLN. Neb.)- We all know driving on icy city roads can be scary, and after a woman received a ticket, she decided to fight it.
“I knew it was a bogus ticket to even give,” said Kelsey Schraer.
Back in January, Schraer says she slid and bumped a car on an icy residential street. Even though no one saw it happen, she called police to report it, and the officer gave her a $149 ticket.
Schraer decided to fight it in court because she thinks if the city didn’t plow the roads, she shouldn’t have to pay.
“Why am I being punished for someone else not doing their job,” Schraer said back in January.
Now she adds, “My foot wasn’t even on the accelerator. Like you can tell from this hill, like right when I backed out, I slid. One of the good points with the cop, he said that he didn’t drive down the hill to where I bumped that car because it was too slippery.”
Nine months later, the court ruled not guilty. She credits her lawyer and the cop admitting the road was icy.
When we did this story in January, Lincoln Police told us there are guidelines for officers to go by. But for the most part, whether to write a ticket in this type of situation is at their discretion.
Because she was found not guilty, Schraer will not have to pay court fees or the ticket. And on top of that, her lawyer represented her for free.
She says it was all worth it, for the principle of it.
“Finally the(September) first, I believe, was the last court date and an hour and fifteen-minute trial and we got it done and, I won,” said Schraer. And as a mother of two, she tells Channel 8 she is glad she doesn’t have to pay for the ticket and that money can go to supporting her family.
