LINCOLN, Neb. (KLKN) — Voters have approved making Nebraska’s current abortion ban part of the state constitution.

The tally as of 2:30 a.m. Wednesday showed 55% of voters supporting Initiative 434.

That measure will amend the constitution to ban abortion in the second and third trimesters, with exceptions for rape, incest and medical emergency.

A dueling ballot measure, which would have expanded access to abortion, failed.

As of 2:30 a.m., there were about 18,000 more “Against” votes than “For” on Initiative 439.

That amendment would have made abortion a constitutional right until fetal viability or if needed to protect the health of the woman.
