Nebraska AG announces two settlements with drug manufacturers

LINCOLN, Neb. (KLKN) – The Nebraska Attorney General’s Office announced two settlements Friday in a multistate lawsuit against generic drug manufacturers.

The settlements resolve allegations that two companies, Heritage Pharmaceuticals and Apotex, conspired to inflate and manipulate drug prices.

The money from the two settlements, which totals $49.1 million nationally, will be distributed to settling states to reimburse consumers and state agencies.

Nebraskans who bought generic prescription drugs from Heritage or Apotex between 2010 and 2018 may be eligible for compensation.

As part of the settlements, Heritage and Apotex will cooperate in the ongoing lawsuit, as well as a series of internal reforms to ensure compliance with antitrust laws.

The investigation into generic drug price-fixing began in 2016, and the allegations were confirmed through phone records and other documents detailing efforts to fix prices and allocate the market.

A federal judge in Connecticut overseeing the litigation granted preliminary approval of a $10 million settlement with Heritage earlier this week.

The settlement with Apotex for $39.1 million will be finalized and filed in the near future.

Forty-seven of the 50 states have joined in on the settlements, with the District of Columbia, the Northern Mariana Islands and the U.S. Virgin Islands also taking part.
