Lincoln man charged with third-degree sexual assault of a 10-year-old girl

LINCOLN, Neb. (KLKN) – A Lincoln man was charged with third-degree sexual assault of a child for the abuse of a 10-year-old girl, an affidavit says.
Mario Davila, 34, appeared in court on Wednesday where his bond was set at 10% of $500,000.
On Feb. 9, officers with the Lincoln Police Department were sent to a home near 27th and Holdrege streets on the report of a sexual assault.
During an interview two weeks later, the 10-year-old girl said Davila used her hand to touch himself inappropriately while they were sleeping in a bed together.
This happened two different times, according to the affidavit. The girl said her brother and mother were also in the bed with them.
When Davila tried again, the girl said she was able to get out and tell her brother, which prompted the call to police.
In an interview on Monday, Davila said the girl touched him on her own.
Davila said multiple times that he made a mistake and felt shame from what happened.
He was arrested on Tuesday morning and lodged in the Lancaster County Jail.
Davila is set to appear in court again on May 7 at 10 a.m.
