On March 1, 2023, Phillips got into an argument with Israel Matos-Colon, 31, at a job site north of Hartington, in Cedar County.
A witness said Phillips was upset that Matos-Colon had talked about his mother, according to an arrest affidavit.
The Nebraska State Patrol said Phillips shot Matos-Colon multiple times. He was taken to a nearby hospital, where he was pronounced dead.
