Cass County attorney dismisses case against man accused in death of Nebraska trooper following mistrial

LINCOLN, Neb. (KLKN) — The case against the man charged in the death of Nebraska State Patrol trooper Kyle McAcy has been dismissed, Cass County Attorney Chris Perrone said on Friday.
Perrone said the case against Thomas Jordan is dismissed following a complete review of the case, discussion with family members of the victim and a conversation with the jurors following the mistrial.

“The State contends the actions of Mr. Jordan operating his snowplow on February 17, 2025 were careless, and therefore criminal, but we also understand the facts lend themselves to valid legal defenses brought forth by the Defendant during trial upon which half the jury agreed,” Perrone said.
In August, Jordan pleaded not guilty to one count of misdemeanor motor vehicle homicide in connection with the death of McAcy.

On Feb. 17, 2025, McAcy was responding to a crash on Interstate 80 between Ashland and Greenwood.
The crash involved a snowplow and two other vehicles, according to the Nebraska State Patrol.
McAcy asked the plow driver to move the snowplow, the patrol said.
Authorities said the driver backed up as McAcy walked away, striking him.
The criminal complaint accused Jordan of careless driving, saying it caused McAcy’s death.
